HB 1034 requires health plans, managed care organizations, and state Medicaid programs beginning January 1, 2026 to avoid prescription drug practices that disadvantage nonopioid pain medications relative to opioids, including prohibiting nonopioid drugs from being designated as nonpreferred when any opioid is preferred and restricting prior authorization or step therapy requirements on nonopioids to be no more restrictive than those applied to opioids. The bill defines nonopioid drugs as FDA-approved products that produce pain relief without acting on opioid receptors, and requires the Department of Health to publish an educational pamphlet by January 1, 2026 covering available nonopioid alternatives and their advantages and disadvantages.
